Why should you sign a prenuptial agreement to avoid get recalcitrance?
The signing of this agreement is a declaration that your marriage will be based on the principles of equality and mutual respect and that just as you enter into it with love and consent you agree that if - g-d forbid - you decide to part ways, this too will take place honorably and justly.
What is in this type of a prenuptial agreement?
All of the existing agreements have various methods to ensure, as much as possible, that the divorce will be based on the principle of equality. In addition, it is possible to add an incentive for the recalcitrant party to agree to cooperate honorably with ending the marriage.
How do you choose the prenuptial agreement that is right for you?
You must look through the various available agreements and check with organizations that provide advice on the issue as to the agreement most suited to you in addition to consulting with an attorney in order to understand the full legal implications. Where do you sign this type of agreement?
Before the marriage ceremony you can sign a prenuptial agreement either before a notary, before the rabbinical marriage registrar, in the Family Court or in the Rabbinical Court.
